Client was operating her auto when her car was struck in the rear by the operator of an automobile, which was insured by GEICO Insurance.

Client vs. ERIE Insurance

District Court for Calvert County

Client was operating her motor vehicle; when the driver of the Erie insured motor vehicle allegedly ran a red light, striking client's vehicle. 

Police arrived at the scene, and detected an odor of alcoholic beverage on client's breath. Client had 2 glasses of wine earlier that evening. Client was subsequently arrested, blew a .09 BAL and charged with DUI.

Erie insurance denied the claim, alleging that client was at fault for drinking alcohol and that their insured claimed client ran the red light. Ted LeBlanc investigated the matter, located a witness who confirmed that the Erie insured ran a red light, and filed suit.

After a contested trial, the Judge agreed that client's consumption of alcohol had nothing to do with accident, that the proximate cause of the accident was the ERIE insured running the red light and a verdict for client of $11,837 was awarded.



Client vs. Allstate Insurance

District Court for Calvert County

Client was operating his motor vehicle, and traveling through an intersection, when he was struck by a vehicle operated by an Allstate insured. Client claimed he had a green light. Allstate insured said she had a green light. Allstate took their insured's version and denied client's claim.
